Buffet: You Choose When Help is Needed
This is often referred to as “unbundled” legal services. Under this type of representation, the client gets to choose when they use the attorney’s services, which enables the client to control their legal costs. This control comes from the fact that, in unbundled representation, the attorney does not enter their appearance as your attorney of record with the court. By not becoming the attorney of record, the attorney is not required to respond to every development in the case, as they would be required to do so in the more traditional style of full-representation (see our VIP: Full Service for comparison). This is when costs can often spiral out of control and lead to some of the horror stories you may have heard about the high legal costs of divorce. By comparison, when representing you in an unbundled manner, you get to choose when and how the attorney will help you. This option can be helpful when you may not know exactly what type of specific help you may eventually need and would prefer to keep your options open rather than committing to a package.

Option to switch to VIP Full Service if you start to get overwhelmed, subject to certain advanced notice and timeline requirements as well as my availability.
VIP Full Service: Case Managed for You
This is often referred to as “full representation” and is what most people think of when they think of having an attorney in their divorce or custody case. When an attorney is hired under a full representation model, they enter their appearance as your attorney of record with the court. Once they become your attorney of records, the attorney is responsible for handling all aspects of your case, including, but not limited to, handling all case correspondence, responding to all case developments, developing case strategy, managing all case deadlines, drafting all documents, filing all documents, preparing for court hearing, and representing you in court. While the attorney taking control of all aspects of the case can offer a great sense of relief, it is important to understand that the ability to control and/or predict costs is more limited under full representation. While every effort will be made to advise the client on ways to help reduce costs where possible, the total cost of this service cannot be determined in advance as the final number will depend on several factors, including the actions of the client, the actions of the other party or parties, complexity of the case, and the number and types of events which may pop up over the court of the case.
Cost:
- $5,000 initial retainer* billed against at my hourly rate (in 0.1 hour increments)
- Minimum balance of $2,000 must be maintained in retainer/trust account at all times
- If case goes to contested hearing, additional trial retainer of at least $6,500** must be paid 65 days ahead of hearing
- Client separately responsible for all costs associated with any experts
* Amount of initial retainer subject to change based on complexity of case
** Amount of pre-hearing retainer will depend on number of issues going to hearing AND length of hearing scheduled. $6,500 represents the minimum retainer replenishment amount.
Option to convert to Buffet or A’la Carte Services during course of case, subject to the court’s approval. If court does not grant request of client and/or attorney to be removed as attorney of record from the case, client remains responsible for all costs of continued full representation.
